These terms apply to everything we supply: mezzanine floors we quote, engineer, manufacture and install, and accessories bought directly through this website. Part A applies to all of it. Part B applies to mezzanine floors and other quoted work. Part C applies to purchases made online. By accepting a quotation, placing an order (online or otherwise), or allowing manufacture to begin, you agree to these terms.
In these terms, "Altivo", "we", "us" and "our" mean Superior Fabrication Limited trading as Altivo. "You" and "your" mean the customer. "Goods" means anything we supply, and "Services" means engineering, installation and related work.
Part A: Terms that apply to everything
1. Quotations and orders
A quotation is valid for 30 days unless it says otherwise. Only the items listed in a quotation or order confirmation are included. Any change to scope, specification or quantity must be agreed in writing and may change the price and timeframe. Nothing said verbally binds either of us unless it is confirmed in writing.
2. Prices and GST
All prices on this website and in our quotations are in New Zealand dollars and exclude GST unless clearly stated otherwise. GST at the current rate is added at the checkout or on the invoice. We take care to keep prices accurate; if an obvious pricing error appears on the website or in a quotation, we will tell you before proceeding and you may cancel the order for a full refund of anything paid.
3. Payment
Payment terms for quoted work are as stated in the quotation. Online purchases are paid in full at the checkout by card. Overdue amounts may incur interest at 2% per month and any reasonable costs of recovery.
4. Title and risk
Ownership of Goods stays with Altivo until we have received payment in full. Risk in the Goods passes to you on delivery, or on collection if you are picking up.
5. Warranties
Structural components we manufacture are warranted against defects in materials and workmanship for five years from the date of supply. Purchased accessories carry the warranty stated on the product page or, where none is stated, twelve months from the date of supply. Warranties do not apply where Goods have been overloaded, altered, installed contrary to our documentation, or used in a corrosive or abnormal environment that was not disclosed to us in writing.
6. Consumer Guarantees Act
If you are buying for personal, domestic or household use, the Consumer Guarantees Act 1993 applies and nothing in these terms limits the rights it gives you. If you are buying for the purposes of a business, you agree that the Consumer Guarantees Act does not apply, as permitted by section 43 of that Act, and that the warranties in clause 5 are the only warranties we give.
7. Limitation of liability
To the maximum extent the law allows, our total liability for any claim is limited to the price you paid for the Goods or Services concerned. We are not liable for indirect or consequential loss, including loss of profit, business interruption, or claims by third parties. We are not liable for loss arising from inaccurate information you supplied, overloading or misuse, unauthorised modification, installation by others that departs from our documentation, or a failure to obtain building consent that was your responsibility.
8. Health and safety
Where we work on your site, we both comply with the Health and Safety at Work Act 2015. You must provide safe site conditions and access, and tell us about any known hazards before we arrive.
9. Disputes and governing law
We will try to resolve any dispute in good faith. If that fails, either of us may refer the dispute to mediation in New Zealand before taking any other step. These terms are governed by the laws of New Zealand and the New Zealand courts have jurisdiction.
10. Changes to these terms
We may update these terms from time to time. The version on this website at the time you place an order is the version that applies to that order.
Part B: Mezzanine floors and quoted work
11. Compliance with the New Zealand Building Code
Our mezzanine floors are designed to comply with the relevant provisions of the New Zealand Building Code at the time of design. That relies on accurate site information from you, confirmation of the design loads and intended use, and no unauthorised design changes. Unless we agree otherwise in writing, obtaining any required building consent is your responsibility. Where it is part of the agreed scope we will supply drawings and Producer Statements (PS1); responsibility for the consent itself remains with you unless we are specifically contracted to manage it.
12. Structural engineering
Structural design is carried out or reviewed by a qualified structural engineer where required. The floor is designed for the loadings stated in the quotation and engineering documentation, and for nothing else. Any change to the intended use, live or point loads, storage configuration, seismic assumptions or supporting structure must be approved by us in writing and, where required, by the project engineer. Unauthorised modification voids all structural warranties and our liability.
13. Design loads and overloading
The floor must never be loaded beyond the Uniformly Distributed Load or point load limits shown on the engineering documentation. You are responsible for making sure the people using the floor understand those limits, for not exceeding them, and for preventing unauthorised alteration. We accept no liability for damage, injury or failure caused by overloading or misuse.
14. Installation
Where we or our approved contractors install, we do so in accordance with the supplied drawings and specifications, and you must provide safe, clear site access. Where installation is by others, it must follow our documentation exactly: all fixings, anchors and connections must meet the specified requirements, and any deviation needs our written approval. We are not responsible for structural failure, injury or compliance problems that result from incorrect installation by a third party.
15. Fire and egress
A mezzanine floor can affect fire separation, means of escape, the fire rating of the existing structure and sprinkler coverage. Unless we are specifically engaged to assess these matters, it is your responsibility to ensure the building as a whole meets fire and life safety requirements.
16. Materials and documentation
Structural steel and components we supply meet the relevant New Zealand standards where applicable, and material certifications are available on request. Materials must not be substituted without our written approval. Where documentation is included in the scope we will provide engineering drawings, load specifications, Producer Statements and installation documentation. Keep it: you will need it for compliance and insurance, and failing to follow it voids our warranties.
17. Building consent
Mezzanine floors are building work under the Building Act 2004 and may require building consent. You are responsible for confirming the requirement with your territorial authority and for obtaining approval before construction, unless we have agreed otherwise in writing. We are not liable for delays, penalties, Notices to Fix or remediation costs that arise from consent failures outside our contracted scope.
18. Insurance
We hold public liability and products liability insurance, and professional indemnity insurance where applicable, each subject to its policy limits and conditions. You are responsible for insuring the building, stored goods, business interruption, and installation risk where installation is by others.
Part C: Buying accessories online
19. What this part covers
Stairs, guardrails, posts, gates, balustrade and other accessories can be bought directly through this website. Mezzanine floor kitsets and extension bays are not sold online; they are quoted, and Part B applies to them.
20. Placing an order
Your order is an offer to buy. We accept it when we send an order confirmation email, at which point a contract is formed. We may decline an order, for example where a product is unavailable or a pricing error has occurred, in which case anything you have paid is refunded in full.
21. Payment
Online orders are paid by card through Stripe, our payment provider. Your card details are entered on Stripe's secure payment page and are never seen or stored by us. The amount charged is the price of the Goods, delivery where it can be calculated, and GST, all shown before you confirm payment.
22. Delivery and collection
Delivery is charged by destination zone and the space your order takes on a truck, and the cost is shown at the checkout before you pay. For some destinations, quantities or items the checkout cannot price delivery; in that case you pay for the Goods only and we will contact you with a delivery cost before dispatch, which you may accept or decline for a full refund. Rural, residential, oversize and tail-lift deliveries carry surcharges, which are shown at the checkout. You may collect from 28 Euclid Avenue, Te Rapa, Hamilton at no charge; we will tell you when your order is ready.
Delivery times are estimates. We are not liable for delay caused by the carrier or by events outside our control, but we will keep you informed. Please check Goods on arrival and tell us about any transit damage within two business days so we can claim against the carrier.
23. Made-to-order items
Some accessories, including stairs and rectangular balustrade or corner components, are made to order to the size or configuration you select. We will tell you the lead time when we confirm the order.
24. Cancellation
You may cancel an order for stocked items at any time before dispatch for a full refund. Made-to-order items may be cancelled without charge until manufacture begins; after that we may retain the reasonable costs incurred to that point.
25. Returns and refunds
Faulty, damaged or incorrect goods. If something arrives faulty, damaged, or is not what you ordered, tell us within seven days of delivery and we will put it right at our cost: repair, replacement or a full refund, at your choice where the fault is significant. Where the Consumer Guarantees Act applies, your rights under it are not affected by anything in these terms.
Change of mind. Stocked items may be returned within fourteen days of delivery provided they are unused, undamaged and in their original packaging. Return freight is at your cost and a restocking fee may be deducted from the refund. Made-to-order items cannot be returned for change of mind.
How to return. Email sales@altivo.co.nz with your order number and we will confirm the return and where to send the Goods. Refunds are made to the original payment method within ten business days of the Goods reaching us and being checked.
