Altivo – Mezzanine Floor Supply (New Zealand)
Effective Date: January 2026
These Terms and Conditions apply to the manufacture, engineering, supply and/or
installation of mezzanine floors and associated components (“Goods” and
“Services”) supplied by Altivo (“we”, “us”, “our”) to the Customer (“you”, “your”).
By accepting a quotation, placing an order, or allowing manufacture to commence,
you agree to these Terms.
- Compliance with New Zealand Building Code
1.1 All mezzanine floors are designed to comply with the relevant provisions of the
New Zealand Building Code at the time of design, subject to:
Accurate site information provided by the Customer;
Confirmation of design loads and intended use;
No unauthorised design modifications.
1.2 The Customer is responsible for ensuring all required building consents are
obtained unless otherwise agreed in writing.
1.3 Where agreed, Altivo may supply documentation including drawings and
Producer Statements (PS1). Responsibility for consent approval remains with the
Customer unless specifically contracted otherwise. - Structural Engineering
2.1 All structural design work is undertaken or reviewed by a qualified structural
engineer where required.
2.2 The mezzanine floor is designed for the specific loadings stated in the quotation
and engineering documentation.
2.3 Any change in:
Intended use
Live or point load requirements
Storage configuration
Seismic assumptions
Supporting structure
must be approved in writing by Altivo and, where required, the project engineer.
2.4 Unauthorised modifications void all structural warranties and liability. - Design Loads and Overloading
3.1 The mezzanine floor must not be loaded beyond the specified Uniformly
Distributed Load (UDL) or point load limits shown on the engineering documentation.
3.2 The Customer is responsible for:
Ensuring occupants understand load limits
Not exceeding specified loads
Preventing unauthorised structural alterations
3.3 Altivo accepts no liability for damage, injury, or failure resulting from overloading
or misuse.
- Installation
4.1 If installation is provided by Altivo or its approved contractors:
Installation will be carried out in accordance with supplied drawings and
specifications.
The Customer must provide safe and clear site access.
4.2 If installation is undertaken by others:
Installation must strictly follow Altivo’s documentation.
All fixings, anchors and connections must meet specified requirements.
Any deviation must be approved in writing.
4.3 Altivo is not responsible for structural failure, injury, or compliance issues
resulting from incorrect installation by third parties. - Fire and Egress Compliance
5.1 The Customer acknowledges that mezzanine floors may impact:
Fire separation requirements
Means of escape
Fire rating of existing structures
Sprinkler system coverage
5.2 It is the Customer’s responsibility to ensure the overall building complies with fire
and life safety requirements unless Altivo is specifically engaged to assess these
matters. - Materials and Quality
6.1 All structural steel and components supplied by Altivo meet relevant New
Zealand standards where applicable.
6.2 Material certifications may be provided upon request.
6.3 Substitution of materials without written approval is prohibited. - Documentation
7.1 Where included in the scope of supply, Altivo will provide:
Engineering drawings
Load specifications
Producer Statements (PS1)
Installation documentation
7.2 The Customer must retain all documentation for compliance and insurance
purposes.
7.3 Failure to follow documented specifications voids warranties and liability
protections.
- Regulatory Compliance
8.1 Mezzanine floors are building work under the Building Act 2004 and may require
building consent.
8.2 The Customer is responsible for:
Confirming consent requirements with the relevant territorial authority;
Ensuring consent approval is obtained prior to construction (unless otherwise
agreed in writing).
8.3 Altivo is not liable for delays, penalties, Notices to Fix, or remediation costs
arising from consent failures outside its contracted scope. - Insurance
9.1 Altivo maintains:
Public Liability Insurance
Products Liability Insurance
Professional Indemnity Insurance (where applicable)
9.2 Insurance coverage is subject to policy limits and conditions.
9.3 The Customer is responsible for insuring:
The building
Stored goods
Business interruption
Installation risks where installation is by others - Limitation of Liability
10.1 To the maximum extent permitted by law:
Altivo’s total liability shall not exceed the contract value of the Goods and/or
Services supplied.
Altivo shall not be liable for indirect, consequential, or business losses
including loss of profit, business interruption, or third-party claims.
10.2 Liability is excluded where loss arises from:
Incorrect information supplied by the Customer
Overloading or misuse
Unauthorised modification
Third-party installation errors
Failure to obtain building consent - Contractual Scope
11.1 Only items specifically listed in the quotation are included.
11.2 Any variation must be agreed in writing and may affect cost and timeline.
11.3 Verbal representations are not binding unless confirmed in writing. - Warranties
12.1 Structural components are warranted against manufacturing defects for 5 years
from date of supply.
12.2 Warranty does not apply where:
Loads are exceeded
Alterations are made
Installation deviates from documentation
Corrosive or abnormal environments are present unless specified in writing - Payment Terms
13.1 Payment terms are as stated in the quotation.
13.2 Title in the Goods remains with Altivo until full payment is received.
13.3 Late payments may incur interest and recovery costs. - Health and Safety
14.1 Where Altivo performs installation, both parties agree to comply with the Health
and Safety at Work Act 2015.
14.2 The Customer must:
Provide safe site conditions
Disclose known hazards
Ensure access compliance - Dispute resolution
15.1 Any dispute shall first be addressed through good faith negotiation.
15.2 If unresolved, the dispute shall be referred to mediation in New Zealand.
15.3 These Terms are governed by the laws of New Zealand. - Acceptance
Acceptance of a quotation, payment of a deposit, or commencement of manufacture
constitutes acceptance of these Terms and Conditions.
